Supreme Court

I'm not a big "politics" guy, but a news story caught my eye today and got me thinking.

This story on Fox News made me curious about the future of the Supreme Court. I know that the original woman is cruising, and it looks like Rehnquist has serious health issues. Will he leave or die before the end of Bush's term as President? If so, then George W. could end up appointing 2 Supreme Court justices. To me that is big! That's like almost 1/4 of the folks on the court. And since the President is a conservative Christian I would assume he would appoint the same type of person to the Court. And this could then affect the decisions of the Court for at least a couple of generations.

It will be interesting to see how this all plays out.

Unfortunately, he's (imho) highly unlikely to get the Dems to allow an up-or-down vote on two conservatives. He might get one, but if he brought forward a second one, the Dems would launch a media blitz about how "balanced" and "fair" the court needs to be, and how he'd be "upsetting the balance" in favor of a "narrow, out-of-the-mainstream minority" view of things.

The problem is, people no longer expect judges to interpret the law. They think of it as the third partisan battleground of our system, where it's "us against them" on an issue-by-issue basis. If the job of judges was still just to interpret the law, then very few people would disagree that we need constructionists on the bench.

The President has promised to nominate people who are in the mold of Scalia and Thomas. Since he sticks to his guns I think we can assume he will follow through. If his nominees are like those guys, Jim is right on... Expect a battle. And, at the end of the day, I suspect W. will nominate people that will make for an interesting battle.
